Oracle and Google may not get to go at each come Halloween depriving
onlookers of a real treat.
District Court Judge William Alsup told the pair Monday that the trial may
have to be postponed.
It all depends on whether a "large criminal" trial starts, as scheduled, on
October 17. If it doesn't then Oracle v Google will pick a jury on October 19
and the trial will start October 31.
Then on Tuesday the judge said there were going to be two Java trials: one on
liability, one on damages and that he's appointed Brigham Young University
professor of economics James R. Kearl as an independent damages expert.
Dr. Kearl, who'll be paid by the court using Oracle and Google's money, needs
"more time" to prepare so if any trial starts October 31 it'll be just the
liability part with the damages part beginning in the first half of December

Salesforce.com (NYSE: CRM), the enterprise cloud computing company, today
announced that companies across Europe, the Middle East and Africa (EMEA) are
adopting cloud computing from salesforce.com in record numbers. In its first
fiscal quarter of 2010, salesforce.com approached 10,000 customers in EMEA -
an increase of roughly 70 per cent from the same period last year.
Salesforce.com's cloud computing model provides many benefits to enterprises
globally requiring only moderate operating expense and offering a
pay-as-you-go, elastic model that can scale with a business' changing needs.
Based on salesforce.com's real-time, multi-tenant architecture, Salesforce
CRM and the Force.com Cloud platform offer the fastest path to customer
success in the cloud. Research firm IDC predicts spending on IT cloud

MySQL Journal on Ulitzer
Monty Widenius, the creator of the MySQL open source database – which is
apparently all that stands between Oracle and its acquisition of Sun –
thinks that Oracle shouldn’t have his baby and that the European Commission
– whose investigation into MySQL has put the Oracle-Sun merger in limbo –
should force Oracle to spit it out to another company.
Oracle CEO Larry Ellison, a guy with a collector’s temperament not given to
letting things that belong to him go, has said he wants to keep MySQL and has
claimed to be watching Sun’s revenue plunge by $100 million a month while
he waits for the EC to finish its probe, a exercise that could take well into
January.
MySQL isn’t supposed to be why Larry shocked everybody and offered $7.4

At SYS-CON Media we see our inventories are filling up to 100% capacity for
the months of November, December, and January, and we are seeing
better-than-normal RFP activity for the first quarter of 2010.
When I say this, I am comparing the current insertion order activity to the
same period last year. We will be closing 2009 roughly 32% below 2008 in
revenues (far better than any other tech media company), which forced us to
reduce our expenses for the same period by around 40%. Last fall, while the
world was falling apart, we were preparing for a 40%-45% drop in advertising
revenues for 2009. We did better than our worst projections.

Opening Keynote at Cloud Expo
Once the news got out that it had welched on its 2005 patent pledge to the
open source community and had threatened TurboHercules (TH) with patent
infringement, IBM had to come up with some cover story or another to contain
the fallout. So it switched places with many of its observers and turned
conspiracy theorist, accusing Turbo Hercules of guilt by association.
Besides calling TurboHercules a couple of dirty names - a stock response to
any threats to its monopoly in order to scare away its rivals' customers...
And besides claiming that it didn't really flat out actually and in fact
accuse TH of infringing - "we did not make any explicit assertions or
